This Privacy Policy (Policy) applies to services provided by Scale Mode Tools LLC (we, us, or our) including the ScaleMode Pro website, product pages, applications, and any other digital products or services that link to or reference this Policy (collectively, the Services).

We may update this Policy from time to time. Material changes will be posted here and/or sent to the primary email on your account. Your continued use of the Services after changes become effective means the collection, use, and sharing of your information is governed by the updated Policy.

Scope and Applicability

This Policy applies when we collect and use personal information through the Services for our own purposes (for example, to operate accounts, provide subscriptions, and improve the product).

This Policy does not apply to third-party websites, applications, or services, even if accessed via our Services. Those are governed by the third party terms and privacy policies.

Information We Collect

Information You Provide

  • Account Information: Email address, authentication credentials, and optional profile information (for example, display name, subscription plan).
  • Payment Information: Payments are processed by Stripe. Stripe receives your full payment details directly; we may store limited billing metadata (for example, customer or subscription IDs, plan, status).
  • Support and Communications: Information you provide when contacting support or otherwise communicating with us.

Information Collected Automatically

  • Log and usage data (IP address, user agent, device or OS, pages and features used, timestamps, referring pages).
  • Device identifiers and configuration data.
  • Cookies, local storage, and similar technologies for authentication, session management, and security.

Information from Third Parties

We may receive information from service providers that help us operate the Services (for example, authentication, database, hosting, or billing providers) and sign-on providers if you use social login.

How We Use Information

  • Provide, operate, and improve the Services.
  • Authenticate users and manage accounts and sessions.
  • Process payments and manage subscriptions.
  • Respond to inquiries and provide support.
  • Monitor usage, prevent fraud or abuse, and enhance security.
  • Enforce one-time product trials using a keyed, non-reversible fingerprint of the normalized account email.
  • Comply with legal obligations and enforce our Terms of Service.
  • Send important notices (for example, service updates or policy changes).

How We Share Information

We do not sell personal information. We may share it as follows:

  • With service providers that help operate the Services.
  • In connection with a corporate transaction (for example, merger, acquisition, or reorganization).
  • To comply with law, protect rights or safety, or enforce our agreements.
  • With your consent or at your direction.

We can provide a list of key service providers upon request.

Cookies and Tracking Technologies

We use essential cookies for operation, including authentication and security. If you choose “Allow analytics,” Google Analytics measures page visits and account or checkout funnel events without receiving the account fields you enter. The Google tag remains off when you choose “Only essential.” Your versioned analytics choice is stored in a first-party cookie for 180 days, can be changed at any time using the button on this privacy page, and is independent on each Scale Mode Tools product domain. You can also control cookies through your browser settings, but disabling essential cookies may affect how the Services function.

Data Retention

We retain personal information as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. When no longer needed, we delete or de-identify information.

Our standard retention schedule is below. A legal hold, active audit, dispute, refund request, chargeback, court order, or different applicable law may require a longer period. When periods conflict, we use the period required for the specific record and jurisdiction, restrict the record to that purpose, and delete or de-identify it when that period ends.

  • Account and product data: kept while the account is active and deleted when an eligible deletion request completes.
  • Deletion receipt: a keyed-HMAC email fingerprint and deletion timestamp are retained for three years after deletion as limited evidence of the request and response under the South Carolina legal-claims period. The record is then scheduled for automatic deletion.
  • Tax and transaction evidence: invoices, payments, refunds, tax calculations, and related accounting evidence are retained for at least four years after the related South Carolina return is filed or due. We may extend a specific record to six or seven years when an applicable federal tax period, audit, refund, bad-debt treatment, or other legal requirement calls for it.
  • Disputes and legal claims: support, chargeback, fraud, security, and contract evidence relevant to a claim is generally retained for three years after the matter closes or the claim accrues, and longer only while a legal hold or proceeding requires it.
  • Recovery copies: deleted DynamoDB records may remain in encrypted production point-in-time recovery copies for up to 35 days. Recovery copies are isolated for disaster recovery and are not used to restore a deleted account into the live service.
  • Communication suppression: the keyed-HMAC suppression fact is retained until you affirmatively opt back in or it is no longer needed to honor your opt-out. Commercial-email opt-outs are applied within ten business days.
  • One-time trial protection: the keyed-HMAC email fingerprint and product-level trial-redemption facts are retained indefinitely for the non-statutory purpose of preventing repeat-trial abuse. They are not used to recreate the account or send promotional email.
  • Stripe records: Stripe independently retains transaction information under payment-services, fraud-prevention, financial-crime, legal, and operational requirements. Stripe states that it generally retains Business User-provided personal data for five or more years after the relationship or last transaction, whichever is later.

The indefinite anti-abuse record and communication-suppression record are purpose-limited business and opt-out controls, not records we claim a tax statute requires us to retain indefinitely.

Security

We implement reasonable administrative, technical, and physical safeguards. No method of transmission or storage is completely secure; we cannot guarantee absolute security.

International Processing

We may process information in the United States and other countries where we or our service providers operate. These locations may have different data protection laws than your place of residence.

Your Rights and Choices

Depending on where you live, you may have rights to access, correct, delete, or request a copy of certain personal information. You may also have the right to object to or restrict certain processing in some circumstances.

California: We do not sell or share personal information as defined under the CPRA, including with respect to consumers under age 16. Nevada: We do not sell covered information as defined by Nevada law.

Certain U.S. state laws provide a right to appeal if we deny your privacy request. To appeal, reply to our decision email or write to the mailing address below with "Privacy Appeal" in the subject line.

Children's Privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from them. If we learn we collected information from a child in violation of this Policy, we will delete it.
